  1. I’m no lawyer, but as I understand it, the my bank won’t allow me to draw down the mortgage until they have the deeds for the property. If that is the case, then your bank will have a hard time proving that the mortgage is still secured on the property.

    Now, if it were to turn out that my bank had allowed the mortgage to be drawn down without getting possession of the deeds, I would think I would be on shakier ground.
